Terms and Conditions (T&C) – Kiin Living Referral Program

1. Definitions
Stay: The operator of Kiin Living and of this Referral Program, responsible for managing and delivering the corresponding benefits.
Referrer: Any current or former resident of Kiin Living who recommends and facilitates a reservation for another person to reside at Kiin.
Referred Party: The person who actually stays in an apartment at Kiin Living upon the Referrer’s recommendation and who signs a residential lease agreement with Stay S.A.S. for a minimum period of one (1) month.
Benefit: Any discount, voucher, or service granted to the Referrer and/or the Referred Party according to the defined program levels, provided that the general conditions—particularly those set forth in Section 2—have been fully satisfied.
2. General Conditions
1. The Program applies exclusively to current or former residents of Kiin Living at the time they register a referral.
2. To qualify for any benefit, the following requirements must be met:
a. The Referred Party must have executed and paid for a residential lease agreement with Kiin Living for a minimum term of one (1) month.
b. The registration must be completed before the Referred Party signs the lease, through Kiin’s official channels (web form or designated email).
c. The Referred Party must have paid the first month’s rent in full to Stay. Said payment shall be deemed a deposit, advance, or rent (as applicable) and is non-refundable, except in the limited refund cases described below.
3. If a Referred Party is registered by more than one resident, the benefit shall be granted to the first confirmed registration received by Stay.
4. Benefits cannot be combined with any other ongoing promotions or discounts.
5. The Referrer shall have a maximum period of six (6) months from confirmation of the Referred Party’s lease to redeem the corresponding benefit, unless it expires automatically.
6. Stay reserves the right to reject any referral without being required to state cause.
7. Stay reserves the right to accept or remove a Referrer from the Program at any time and at its sole discretion.
8. The timeframe to upgrade to a higher level is six (6) months from recognition of the current level; upon expiration, progress resets.
9. The timeframe to redeem any voucher or benefit is six (6) months from the date of recognition thereof or from payment of the Referred Party’s first month’s rent, whichever applies.
10. Stay may terminate this Referral Program at any time, provided that all referrals already meeting the above conditions are honored.
11. Participation in the Program constitutes full knowledge and acceptance of these Terms and Conditions by the Referrer.
12. Referrals registered prior to the issuance of this Program shall not accumulate; all counts are reset as of this date.
13. The Referrer acts as an entirely independent party and shall not be deemed an employee, agent, or contractor of Stay.
14. The Referrer is not authorized to advertise, promote, or represent Kiin Living and shall not be considered to have any collaboration, agency, representation, or partnership relationship with Stay.
3. Restrictions and Refund Policy
1. Roommates or current registered residents of Kiin Living cannot be referred.
2. Limited refund exceptions: refunds (or equivalent credits) will be granted only in duly justified and documented cases, including:
a. Death of a first-degree relative (upon presentation of death certificate).
b. Serious illness of the Referred Party or a first-degree relative preventing compliance with the lease, supported by a medical certificate.
c. Force majeure or acts of God as defined under Colombian law.
d. Verified material error by the lessor or sales agent (e.g., duplicate charge or administrative failure).
e. Other causes mutually agreed in writing and expressly authorized by Stay.
3. Procedure and timeframe:
- The Referred Party must submit a written refund request (email or agreed channel) within fifteen (15) business days from the date the cause arises.
- Supporting documentation (medical certificate, death record, or official evidence) must be attached.
- Once verified and approved, Stay shall process the refund or credit within fifteen (15) business days of approval.
- Requests lacking required documentation or justification shall be denied.
- Any refund shall be net of banking fees and the cost of any benefit already granted to the Referrer, if redeemed.
4. Non-transferability and non-compensation:
Payments and benefits may not be transferred to third parties without Stay’s express written authorization. Unused benefits or services shall not entitle the participant to any compensation or refund, except as expressly authorized herein.
5. Residual clause:
In case of conflict between this clause and any other contractual provision, this clause shall prevail regarding non-refundability, unless mandatory law provides otherwise. Any tolerance or delay in enforcement shall not constitute a waiver of rights.
6. Other provisions:
This Program does not create any additional relationship between the parties nor authorize either to represent or bind the other in any manner.
Services and benefits are subject to the individual terms, capacities, and reservation policies applicable to Kiin Living, Wake Biohotel, or other participating partners.
7. The specific lodging conditions of Kiin Living are governed by the corresponding urban residential lease agreement.
8. Benefits are personal, non-transferable, and non-redeemable for cash. They may not be assigned to third parties or to Referred Parties.
9. If the Referred Party cancels the stay before completing one (1) month or fails to pay rent, no benefit will be granted.
10. Stay may terminate or modify this Referral Program unilaterally at any time; such modifications shall be communicated through Kiin’s official channels.
4. Data Protection and Processing
By registering a referral, the Referrer represents that they have obtained the Referred Party’s express authorization to share their personal data with Kiin, in compliance with Law 1581 of 2012 and Stay S.A.S.’s Data Processing Policy, under which such information remains property of Stay and will be processed in accordance with applicable law.

By submitting personal data, both the Referrer and the Referred Party authorize Stay S.A.S. to store, process, and monitor service performance.
The Referrer authorizes Stay, in accordance with Law 1581 of 2012, to manage, process, and store personal information provided through any marketing channel (websites, call centers, etc.), and undertakes to promptly update such information whenever changes occur.
5. Term
This Referral Program shall remain valid until October 1, 2026, unless extended or modified by Stay and duly announced through Kiin’s official communication channels.
